Justice files Published Oct. 9, 2009 By 436th AW legal office DOVER AIR FORCE BASE, Del. -- During the third quarter, the Dover Air Force Base legal office administered the following courts-martial and nonjudicial punishments under Article 15 of the Uniform Code of Military Justice. Courts-Martial Airman Ashley N. Johnson of the 436th Dental Squadron was tried and convicted by special court-martial and was sentenced to a bad-conduct discharge, four months confinement, and reduction to airman basic for multiple uses of marijuana. Airman 1st Class Francis J. Butta of the 436th Aircraft Maintenance Squadron was tried and convicted by special court-martial and was sentenced to a bad-conduct discharge, 30 days confinement, and a reduction to airman basic for multiple wrongful uses of Oxycodone and failing to go to his appointed place of duty. Airman 1st Class Wendell A. Riley of the 436th AMXS was tried and convicted by special court-martial and was sentenced to a bad-conduct discharge, five months confinement, and a reduction to airman basic for multiple wrongful uses of Oxycodone and wrongful distribution of Oxycodone. Nonjudicial Punishment (Article 15s) A senior airman from the 436th Aerial Port Squadron received a suspended reduction to airman first class, forfeiture of $929 pay per month for two months, and 45 days extra duty for being drunk and disorderly off-base. A senior airman from the 436th APS received a reduction to airman first class, forfeiture of $929 pay per month for two months, and a reprimand for driving under the influence of alcohol while in California. An airman first class from the 436th APS received a suspended reduction to airman, forfeiture of $784 pay per month for two months, 45 days extra duty, and a reprimand for being drunk and disorderly off-base. An airman first class from the 436th APS received a suspended reduction to airman, 45 days extra duty, and a reprimand for improper spotting of a vehicle and failing to maintain coordination with his spotter while operating a vehicle. An airman first class from the 436th APS received a suspended reduction to airman, 45 day extra duty, and a reprimand for failing to go to his appointed place of duty. A senior airman from the 436th APS received a suspended reduction to airman first class, 45 days extra duty, and a reprimand for failing to report to work immediately after an appointment and making multiple false official statements. A senior airman from the 436th APS received a reduction to airman first class, 30 days extra duty, and a reprimand for not completing a permanent change of station out-processing checklist. An airman first class from the 436th AMXS received a suspended reduction to airman, forfeiture of $784 pay per month for two months, and 30 days extra duty for making a false official statement, indecent acts, and adultery. An airman first class from the 436th Civil Engineer Squadron received a reduction to airman for incapacitation for performance of duties due to drunkenness. A senior airman from the 436th CES received a reduction to airman first class and 15 days extra duty for failing to go to his appointed place of duty and incapacitation for performance of duties due to drunkenness. An airman first class from the 436th DS received a reduction to airman, a suspended reduction to airman basic, forfeiture of $699 pay, suspended forfeiture of $699 pay, and 30 days extra duty for failing to go to appointed place of duty, failing to obey a lawful order, for having an unaccompanied person in a dorm room, failing a dorm room inspection, and disrespect to a superior non-commissioned officer. A senior airman from the 436th Logistics Readiness Squadron received a suspended reduction to airman first class, 20 days extra duty, and a reprimand for failing to go to fit camp. An airman first class from the 436th LRS received a reduction to airman basic, 45 days extra duty, 45 days restriction to Dover Air Force Base, and a reprimand for using marijuana. A staff sergeant from the 436th Maintenance Operations Squadron received a reduction to senior airman and 45 days extra duty for driving under the influence of alcohol off-base and unlawful entry into an off-base residence A staff sergeant from the 436th MOS received a reduction to senior airman and 15 days extra duty for failing to expose Airmen to aircraft prior to signing their on-the-job training records. An airman from the 436th Maintenance Operations Squadron received a reduction to airman basic, 15 days extra duty, and 15 days restriction to Dover Air Force Base for failing to go to his appointed place of duty. An airman from the 436th Maintenance Squadron received a reduction to airman basic, 45 days extra duty, and 45 days restriction to Dover Air Force Base for being absent without leave for more than three days and failure to obey a lawful order from a superior commissioned officer. An airman first class from the 436th Medical Support Squadron received a reduction to airman, suspended reduction to airman basic, suspended forfeiture of $699 pay per month for two months, and suspended 15 days extra duty for underage drinking and driving under the influence of alcohol on-base. An airman from the 436th Security Forces Squadron received a suspended reduction to airman basic and a reprimand for failing to go to his appointed place of duty and reckless operation of a motorcycle on-base. A staff sergeant from the 436th SFS received a reduction to senior airman and a reprimand for adultery. An airman first class from the 736th AMXS received a suspended reduction to airman and 30 days extra duty for failing to report to work in uniform and failure to obey a lawful order from a senior non-commissioned officer. An airman first class from the 736th AMXS received a reduction to airman and 30 days extra duty for sleeping on post while performing augmentee duties. A senior airman from the 9th Airlift Squadron received a reduction to airman first class, suspended forfeiture of $929 pay per month for two months, and 14 days extra duty for driving under the influence of alcohol off-base.
